This Intellectual Property Rights Policy outlines the guidelines and responsibilities related to the creation, use, and distribution of content on our platform. By using OMS2, you agree to comply with this policy and all applicable intellectual property laws.
1. User-Generated Content Ownership
By uploading or submitting Content to OMS2, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content for the purpose of operating, promoting, and improving our services. This license ends when you delete your Content or your account unless the Content has been shared with others and they have not deleted it.
- Event Creators: As an event creator, you retain ownership of all original content you create and upload to the platform, including event descriptions, images, videos, logos, and promotional materials (collectively referred to as "Content").
- Attendees and Users: Any content you submit, such as reviews, comments, or shared materials, remains your intellectual property.
2. Responsibility for Content
- Accuracy and Legality: You are solely responsible for ensuring that your Content is accurate, lawful, and does not infringe upon the intellectual property rights of any third party.
- Permission and Rights Clearance: Before uploading any Content, you must have all necessary rights, licenses, permissions, or consents to use and authorize OMS2 to use the Content as described in this policy.
3. Prohibited Content
You may not upload, post, or transmit any Content that:
- Infringes on Copyrights or Trademarks: This includes unauthorized use of copyrighted material, trademarks, logos, or proprietary information belonging to others without permission.
- Violates Privacy Rights: Content that discloses personal information about another person without their consent.
- Contains Unauthorized Recordings: Recording or sharing audio, video, or photographs of individuals without their consent, especially in private settings.
4. Use of OMS2 and Commonly Intellectual Property:
- Trademarks and Branding: OMS2 and Commonly logos, trademarks, service marks, and branding elements are the intellectual property of Temp and Major Inc. You may not use these elements without prior written consent, except as permitted under this policy.
- Limited License for Promotion: Event creators are granted a limited, non-exclusive license to use OMS2 and Commonly branding materials for the sole purpose of promoting their events on the platform. Any use must comply with our branding guidelines and not suggest endorsement or partnership beyond the services provided.
5. Referral Links and Promotional Materials:
- Referral Program Content: Users participating in the Ticket Split Referral Program may use provided promotional materials and referral links to share events. All such materials must be used as provided without modification unless authorized.
- Compliance with Policy: Referral content must not infringe on intellectual property rights and should adhere to the User Conduct & Sharing Policy.
6. Reporting Intellectual Property Infringement
If you believe that your intellectual property rights have been infringed upon by content on OMS2, please notify us immediately by:
- Contacting Us: Send an email to help@oms2.org with the subject line "Intellectual Property Infringement Notice.&quiot;
- Provide the Following Information:
- A description of the copyrighted work or trademark that you claim has been infringed.
- The exact URL or event where the alleged infringing material is located.
- Your contact information, including name, address, telephone number, and email address.
- A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the intellectual property owner or authorized to act on the owner's behalf.
We will promptly investigate all notices of alleged infringement and take appropriate actions, which may include removing or disabling access to the infringing material and terminating accounts of repeat infringers.
7. Counter-Notification
If your Content has been removed due to an intellectual property infringement claim, and you believe it was mistakenly removed, you may send us a counter-notification to [Support Email] including:
- Identification of the Content that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the Content was removed as a result of a mistake or misidentification.
- Your contact information.
- A statement that you consent to the jurisdiction of the federal court in your district, and that you will accept service of process from the person who provided the original infringement notification.
Upon receiving a valid counter-notification, we may restore the Content in question unless the original complainant files a court action against you within ten business days.
8. Termination for Repeat Infringement
- OMS2 reserves the right to terminate user accounts that are subject to repeated infringement claims. We take intellectual property rights seriously and expect our users to respect the creative works of others.
9. Limitation of Liability
- OMS2 and Commonly are not liable for user-generated Content that infringes on third-party intellectual property rights. Users are responsible for their own Content and any consequences of posting or publishing it.
10. Changes to This Policy
- We may update this Intellectual Property Rights Policy from time to time. Any changes will be effective upon posting the revised policy on the platform. Your continued use of OMS2 constitutes your acceptance of the updated policy.
